Rastafarian community of Kenya at milimani court

Today Rastafari Society of Kenya (RSK) filed a petition at Milimani Law Courts asking that the use of cannabis be decriminalised for spiritual purposes. 


The Rastafari Society of Kenya at Milimani Law Courts 

 Lead by lawyer Danstan omar and other rastafarian members  they argue that Rastafarians use cannabis (also called “bhang”) in many forms including smoking, drinking, eating, bathing, burning incense  as a sacrament and part of their religious practice. 


Their claim is that current law of  Narcotic discriminates against them by criminalising their sacramental use. 


Through their lawyers (including Danstan omar), they are asking the court to:

1. Declare the relevant sections of the drug law (specifically around cannabis) unconstitutional as applied to them. 

2. Stop the police from arresting or prosecuting members of their faith if they use cannabis in their homes or tabernacles (designated places of worship). 


This is they petition thair case on 17th May 2021, before the High Court of Kenya seeking the decriminalization of cannabis plant (ganja) for sacred (meditation) and medicinal use among the Rastafari faithful.
